Shelters
1. As stated in paragraph 79 of Article 2 of the N.O.K.:
A canopy is an inaccessible fixed structure, on a cantilever or on columns, constructed with solid fixed or movable elements on its roof.
The canopy may either be placed in contact with one side without forming a continuation of the load-bearing structure, provided that it is made of a different material, or it may be placed at a minimum distance of d/4 from any side of the building, without the above restrictions applying.
Vertical infill elements are permitted, subject to the opinion of the Architectural Council, provided that they do not create an enclosed space.
Comment: The phrase “excluding any other vertical infill elements” has been deleted here.

2. Required permit
Small-scale construction works (Paragraph 2 of Article 29 of Law 4495/2017).
After approval of works (Administrative act allowing the execution of works under paragraph 2 of Article 29), the works described below are permitted after submission of a technical report and a declaration of supervision by a competent engineer:
la) Shelters and shelters referred to in paragraphs 72 and 79 of Article 2 of Law 4067/2012
where the following are submitted:
1) Topographical diagram or copy of the topographical diagram, as specified in paragraph 3(e) of Article 1.
2) Coverage diagram showing the structures with their dimensions.
3) Engineer’s technical report describing the proposed structures and certifying that the conditions set out in paragraph 6(f) of Article 11 and paragraphs 7(i) and 7(k) of Article 17 of Law 4067/2012 are met.
4) Floor plans and sectional drawings, on a scale of 1:100 or 1:50.

3. Positions constructed
2.3.2.1. Shelters in any location, provided that they are developed within the mandatory uncovered areas and the planting obligation is covered, in accordance with §7 of Article 17.

On the uncovered areas of the plot and provided that the planting obligation is met, in accordance with paragraph 2, the following structures are permitted:
ia) Canopies in any position.

Paragraph 8Ba of Article 17 of the NOK is reproduced below:
B. On their surface (Note: Of the front gardens) except for those referred to in other articles of Law 4067/2012, provided that the planting obligation is met:
a) Pergolas, roofless structures for the reception of water elements, swimming pools with the necessary facilities for their operation, mobile or permanent shelters, canopies, and outdoor parking spaces, without maximum width requirements and up to the building line.

4. Permissible dimensions
Paragraph 4.f. of Article 17 of the NOK:
4. Within the minimum distances Δ or δ of the mandatory uncovered space, except as specified in other articles of this law, the following are permitted:
f) Architectural projections and architectural elements, volumetric projections and decorative elements, movable or fixed shading systems, structures for the maintenance of the shell, technical system conduits, such as chimneys, air ducts, gutters, canopies, and shelters. The maximum width of all of the above is equal to 1/4 Δ or 1/4 δ.
To calculate the distance Δ or δ, the height of the building at which the building coefficient is expected to be exhausted in the future can be taken as the variable H.
The manner in which the building coefficient is exhausted is illustrated by a dotted line in the schematic section of the building diagram, which also includes a solemn declaration by the owner with his consent.
