Detailed examples for calculating fines related to the regularization of unauthorized buildings were provided today by the leadership of the Ministry of Environment at a press conference.

1st calculation example
within the plan, with building permit, main and only residence
exceeding 50 sq.m., construction time 2005, T.Z. 1000/1150 (new-old)
old fine: 0.15x50x1150x0.60×1.00=€5175
new fine: 0.15x50x1000x0.40×1.00=€3000

2nd Example calculation
within plan, with building permit, other residence,
exceeding 100 sq.m., time of construction 1990, T.Z. 1300/1600
old fine: 0.15x100x1600x0.60×0.80=€11,520
new fine: 0.15x100x1300x0.60×0.60=€7,020

3rd calculation example
within the plan, with building permit, services (shop),
exceeding 50 sq.m. (loft), construction time 2007, T.Z. 1650/2000
old fine: 0.15 x50x0.50x2000x0.60×1.00=€4500
new fine: 0.15 x50x0.30x1650x0.60×1.00≅2230

4th Calculation example
within the plan, without building permit, other residence,
exceeding 70 sq.m., construction time 1981, T.Z. 900/1000
old fine: 0.15x70x1000x0.60×0.15 x2.0=1890 €
new fine: 0.15x70x900x0.60×0.15 x1.3 ≅1105 €

5th calculation example
outside the plan, without a building permit, main and only residence
exceeding 80 sq.m., construction time 2006, T.Z. 600/600
old fine: 0.15x80x600x0.40×1.00×1.7×2.0=€9792
new fine: 0.15x80x600x0.40×1.00×1.5×1.3=€5,616

6th Calculation example
outside the plan with pending urban planning study, without building permit, other residence
exceeding 120 sq.m., construction time 1998, T.Z. 600/600
old fine: 0.15x120x600x0.60×0.80×1.7×2.0≅17625 €
new fine: 0.15x120x600x0.60×0.80×1.2×1.5 ≅€9,330

7th Calculation example
outside the plan, in an environmentally sensitive area, without a building permit, services
exceeding 600 sq.m., construction time 2005, T.Z. 600/600
old fine: 0.15x600x600x0.60×1.00×1.7×2.0=€110,160
new fine: 0.15x600x600x0.60×1.00×1.5×2.0 x1.2=€116,640

What they said at the press conference

Furthermore, according to Deputy Minister of Environment Yannis Tsironis, under the current regime, fines for non-compliance are very high, making it impossible to pay them off. As he said, the fines are intended to record the built-up area so that, where necessary, unauthorized buildings can be demolished and, where deemed necessary, the resources can be made available to carry out environmental restoration interventions.

“25% of the new fines will go to the Built Environment Observatory, so we will have resources for demolitions that we did not have before, but which came from the state budget. Now this will not be the case, they will not need to go into a general fund called the Green Fund. Of course, 50% will go to the Green Fund, but there we are discussing very seriously how to utilize the resources of the Green Fund, which are currently dormant. However, there is 25% that will go directly to the municipalities, always under the supervision of the Green Fund, for immediate interventions,” he noted.

For the transfer of the building coefficient

According to Rena Klampatsa, Secretary General for Spatial Planning, the process of transferring building rights “concerns a specific property from which it is leaving in any case, but where it will go concerns an area. This immediately brings to the fore the fact that we need to find this thread, which, from where I transfer it to where I direct it, the place where I direct it must have this capacity, not only in terms of the property itself, but also in terms of the wider area of the Zone, i.e., where it is to be transferred. In this context, the specifications for the building coefficient reception zones have been issued. They have been issued for pilot implementation in Attica because it is understood that we need to be careful about this issue in wider areas, even outside the neighboring municipality, as the provision initially stated.

“These Zones will be defined by Presidential Decrees and will therefore be subject to review by the Council of State and to scrutiny as to whether these Zones – always within the plan, and I emphasize this point – are indeed within the plan – ZYS (Reception Zones) can withstand and accommodate a coefficient that is transferred for reasons related to the protection of our cultural and architectural heritage, or for those who give up their right to build on their property because someone else owns it. In being able to have sufficient public spaces based on the urban plan that was originally approved. And we have reached a point where many of these plans are outdated precisely because they lost the percentage they owed to all the people living in the municipality.
