A few words about parking spaces

1. The possibility of purchasing parking spaces applies only (Law 3044/2002, paragraph 4, article 14):

a. In the case of properties referred to in paragraph 2 of Article 3 of Law 960/1979 (properties on which the creation of parking spaces is prohibited – see paragraph 3 of Article 2 of Law 960/1979 for Attica).

b. In cases of real estate that meets the conditions a to g of paragraph 3 of Article 3 of Law 960/1979, as amended by Law 1221/1981.

In such cases, the following applies (Article 3, paragraph 4 of Law 1221/81): In the case of real estate to which, according to the provisions of this law, a reduced contribution applies, this contribution is set at one quarter (1/4) of the amount calculated in the previous paragraph.

2. When there is a change of use, the calculation is as follows:

A. Calculate the required positions for the old use (Article 2 of Presidential Decree 111/04), e.g.:

A1. Old use of store: required spaces 1 space /60 m² =X

A2. Old warehouse use: required spaces 1 space /60 m2 =Ψ

Total number of positions required: X + Y = Z

B. The required positions for the new fiscal year are calculated (Article 3 of Presidential Decree 111/2004), e.g.:

B1. New use as a café: required seats 1 seat /40 m² =Ω

C. The difference between the required new and old positions Ω-Ζ is calculated, which gives the required positions.

The above is in accordance with paragraph 3 of Article 4 of Presidential Decree 111/2004, which specifies that:

In cases of change of use in buildings that legally existed in Attica until March 5, 2004 (date of entry into force of Presidential Decree 111/2004), it is considered that the number of parking spaces corresponding to the existing use has been secured in accordance with the provisions of Article 2 of Presidential Decree 111/2004, which is deducted from the number resulting from the new use on the basis of Article 3.

3. Additions per’ height

The following applies to additions in height: For residences, one parking space per 150 m² of building area.
