Requirements:

Allow the issuance of a building permit.

The plot must have the minimum frontage required for the station’s traffic connection.

Comply with the environmental conditions of Law 1650/ 86.

The safety distances provided for by the provisions set out in the provisions set out in the provisions set out in the provisions set out in the provisions which are provided for by the provisions of Articles 3 & 4 of Presidential Decree 455/76 as it is currently in force.

Be the owner of the property (land) on which the car station will be built, or have the legal right to use it.

A solemn declaration by the interested party that “has not been convicted in the last five years for fuel adulteration and is not subject to the penalties of Law 1763/88 for an irrevocable conviction for insubordination or desertion and that they have the legal right to use the land.

Notes and explanations: The operating license for an outdoor car park is valid for 3 years and is renewed after the legal documents have been submitted.

In the event that special provisions apply to a particular region, additional supporting documents may be required.

If the supporting documents are not submitted by the applicant himself, the signature on the application and the solemn declaration must be certified by any public, municipal, or community authority, and any photocopies (of identity cards, driving licenses) must be certified.
Requirements for establishing a private nursery school
-
In order to establish a VAT Unit, it is necessary to have a suitable plot of land or building with the appropriate land area.
-
F.P.A.D. units are established in urban and semi-urban areas. It is prohibited to install F.P.A.D. units in buildings when parts of these buildings are used for other purposes, having a common entrance or exit with the F.P.A.D. unit.
-
The F.P.A.D. Unit’s stadium must be level with slight slopes, comply with the land use conditions of the applicable urban planning legislation, be at least 300 meters away from the perimeter of an approved industrial zone, noisy workshops and, in general, unhealthy and annoying facilities, as defined by the competent committee under the law, in accordance with the applicable health provisions, and be served by drinking water, electricity, and telephone networks.

Exceptionally, a VAT unit may be established in a non-polluting industrial/craft area for the children of employees working there, provided that there is no industrial or craft facility that is unhealthy or noisy, as defined above, within a distance of at least 300 meters.
Establishment license
The Establishment License is granted by the Directorate or Department of Social Welfare of the Prefecture.
Local government of the place where the unit is located, after submitting the following supporting documents:

Application by the natural or legal person, stating their details (or the details of the person legally responsible for the legal entity), the name, type of unit (nursery, crèche, or nursery school, etc.), its registered office, the maximum number of infants or toddlers to be served, and the specific purpose of the unit.

Report justifying the name of the Unit.
-
Complete topographical diagram and series of architectural plans in accordance with Circular 98 of the Ministry of Public Works, Housing and Civil Protection, Ref. No. 82070/22.12.89, concerning the preparation of studies for the issuance of building permits.
-
Building permit or other certificate or confirmation of legality of existing building, from the competent Urban Planning Authority (or Urban Planning Office), in the case of renovation or extension of an existing building.
Technical report by the engineer, in two copies, which shall include, among other things:
-
A description of the accessibility of the plot.
-
The condition of access roads and the stage of progress in implementing the approved street plan.
-
The availability and adequacy of water supply, electricity, telephone connection, and sewerage.
-
Table of finishes and description of the building’s construction in general.
-
The number of children (infants or toddlers) by age that will be served by the F.P.A.D. Unit, a full description of its departments and their operation (e.g. opening hours, services provided such as meals, etc.) as well as the Internal Operating Regulations of the F.P.A.D. Unit.
-
A solemn declaration by the person responsible, in whose name the license will be issued, in accordance with Law 1599/86, expressly stating their compliance with the provisions of this article, paragraph A, clause 2.
-
Certificate of Criminal Record of the person in whose name the Establishment License will be issued, stating that he/she has not been convicted of any felony or of any of the misdemeanors of theft, embezzlement, fraud, extortion, forgery, slander, counterfeiting, and violation of drug laws, or for a crime related to public morals, and that they have not been deprived of their civil rights due to a conviction for any criminal offense.

Certificate from the Public Prosecutor’s Office of the applicant’s place of residence stating that they are not being prosecuted, or a solemn declaration under Law 1599/86.

Affidavit pursuant to Law 1599/86 stating that the applicant has not been subject to any prohibition or judicial seizure.
-
The commercial company that is added to establish a VAT Unit must attach a certified copy of its articles of association. The supporting documents referred to in paragraphs 7, 8, and 9 of this document must be submitted for all members of the company’s management and, in any case, for the members of any VAT Unit management that may be established.

Fee of 50,000 drachmas in favor of the N.A. (Proof of payment)

All of the above supporting documents must be submitted to the Social Welfare Directorate or Department of the relevant Prefectural Authority (two copies of the plans must be submitted).
-
The Social Welfare Directorate (or Department) approves or rejects the above documents, giving reasons for its decision. Once the plans have been approved from an operational standpoint, the complete file is submitted to the competent Urban Planning Authority (or Urban Planning Office) for the issuance of the Building Permit (together with the plans approved from an operational standpoint). For existing buildings that have a legal building permit, the same procedure is followed, but the building permit for new use is issued by the competent Town Planning Office, in accordance with the provisions of Article 5 of the General Building Regulation:

No. 1577/85, as amended and supplemented. After the building permit has been issued, the following are submitted to the Social Welfare Directorate (or department)

The approved complete architectural study and
-
The private lease agreement, in the event that the building is rented, certified by the competent tax office and the Establishment Permit is granted.

Operating License
-
Application by the person (natural or legal) in whose name the license will be issued, mentioning the number of the License granted for the Establishment.

Responsible statement pursuant to Law 1599/86, Article 8, that it will proceed with the recruitment of the personnel provided for in this Decision.

A copy of the permit certified by the Town Planning Office for the completion of the building. The Operating License is then issued by decision of the Prefect, following an opinion from the legally competent Suitability Committee that the Unit meets the terms and conditions of this decision. A representative of the collective body of VAT Unit owners, if any, participates in this committee.
Revision of the Operating License is necessary when one of the following elements changes:

The ownership status of the VAT Unit.

The number of infants and toddlers that the F.P.A.D. Unit can serve.
-
The Internal Operating Regulations of the VAT Unit.
-
The building infrastructure of the VAT Unit (renovations, additions, etc.).
