When is it mandatory to issue an electronic ID without transferring ownership of a building?

In Articles 52-63 of Law 4495/2017 (as amended by Law 4643/2019 and Law 4759/2020) defines the procedure that must be followed for the issue Electronic Identity of a building/independent divided property and the issue of the certificate of completeness that accompanies it.

It should be noted that until 2017, the legislation on electronic identity cards provided for regular periodic inspections and identification of all buildings in the country. However, thanks to the efforts of POMIDA, this was limited to a one-off inspection upon the transfer of each property, except for buildings of public interest, for which the issuance of an electronic identity card is mandatory within five years from February 1, 2021, i.e., by January 31, 2026. In other words, POMIDA has not only managed to exempt all property owners in the country from the constant and unjustified periodic inspections of their properties, but also to exempt the owners of all residences in the country and most commercial buildings and offices from the obligation to immediately issue an electronic ID.

 

The cases in which the issuance of an electronic identity card is mandatory to be done within five years, i.e. described in detail in Article 55 of Law 4495/ 2017 and are the following:

a. Buildings belonging to the State, local authorities, and public entities, as well as those housing services of the State, local authorities, and public entities.

b. Public gathering buildings: theaters, cinemas, assembly halls for social, economic, cultural, and religious events, conference centers, and exhibition buildings. This category also includes cultural facilities (libraries, museums, exhibition halls), sports facilities (indoor gyms, stadiums with stands and enclosed auxiliary areas, professional football club stadiums, Olympic sports facilities), public transport transfer stations.

c. Petrol stations and car repair shops: buildings or parts of buildings used for petrol stations or car washes, as well as all types of car repair shops.

d. Tourist accommodations larger than three hundred (300) square meters.

e. Education: public and private buildings for preschool, primary, secondary, and tertiary education.

f. Health and social welfare: healthcare buildings (hospitals, medical centers, clinics, rural and regional clinics, mental health centers, health service centers). This category also includes: nurseries, daycare centers, boarding schools, retirement homes, institutions for the chronically ill, institutions for people with special needs, and shelters.

g. Correctional facilities: detention centers, special detention centers for young people.

 

Documents required for obtaining an Electronic Identity Card

The documents required for the creation of an electronic building ID/independent divided property are as follows:

a) the building permit for the building in which the divided property is located, with any revisions thereto.

b) the plans accompanying the building permit, as well as the accessibility study for persons with disabilities and persons with reduced mobility, if required.

c) the energy performance certificate of the divided property.

(d) the construction inspection certificate, if issued.

e) declarations of compliance with laws suspending the imposition of penalties for arbitrary acts.

f) floor plans showing the divided ownership in its actual state, when this is not apparent from the information in points a), b) and e), except for common areas

g) the structural vulnerability report or the technical report on static inspection accompanying the application for inclusion in Law 4178/2013 or this law, or the static adequacy study, if required, in accordance with Article 99.

h) the table of millimeters and the study of the distribution of building expenses, if available.

 

If the building permit and accompanying documents cannot be found in the records of the relevant department, a certificate of loss issued by the competent Building Department must be submitted instead.

In closing, we would like to point out that because the issuance of an Electronic Identity Card is a time-consuming process that requires many supporting documents issued by several agencies (urban planning departments, municipalities, engineers, etc.) and often involves significant delays, interested owners should begin the collection process and the inspection by the competent authority in a timely manner. engineers, etc.) and often with long delays, interested owners should start the process of collecting them and having the engineer inspect the property in good time so that the ID can be issued by the deadline of January 31, 2026.
