Revision of building permits indefinitely based on Law 4067/2012

The Directorate of Architecture, Building Regulations, and Licensing of the General Directorate of Urban Planning of the Ministry of Environment and Energy issued a document with clarifications regarding the indefinite revision of building permits based on Law 4067/2012.

The document states the following:

Subject: Indefinite review of building permits pursuant to paragraph 6 of Article 29 of Law 4067/2012

c) Document no. 324/20-4-2016 of the Technical Services Department of the Municipality of Sitia

In response to (a) & (b) relevant documents, which concern the implementation of paragraph. 6 of Article 29 of Law 4067/2012, we inform you of the following:

Pursuant to paragraph 6 of Article 29 of Law 4067/2012 (79 A), as amended and in force,
“The validity of building permits falling within the scope of paragraph 3a of Article 6 of Presidential Decree (D’ 795) until 31.12.2017, in order to complete the facades and any roof of the building and to comply with paragraph 4c of Article 6 of Law 4030/2011. No building permit revision is required for this work, only written notification to the competent Building Authority, which is communicated to the relevant police department.

The above provision regulated buildings whose load-bearing structure was erected on the basis of building permits issued under Presidential Decree 795D of July 8, 1993 (795D) and which were not revised for an indefinite period of time in accordance with paragraph 3a of Article 6 of the above decree, as provided for by the older method of issuing building permits, they were given the opportunity to complete their facades and any roofs in order to comply with paragraph 4c of Article 6 of Law 4030/2011 and continue their work.

It should be noted that, in our opinion, for the purposes of applying the above provision, the completion of the load-bearing structure concerns all buildings that are to be constructed under the building permit (building license), since both Presidential Decree 8-7-1993 (795D) and Law 4030/2011 (249A) do not define the concept of partial revision of a building permit (building license) for an indefinite period of time. It is therefore clear that in the case referred to in (a) above, where the load-bearing structure has been completed in five of the six buildings provided for in the original building permit, the validity of which has expired, a new building permit must be issued by the relevant building authority in order for them to be completed.
