Obligation to provide W.C. for people with disabilities in K.Y.E.?

Question: Is there a requirement for W.C. facilities for persons with disabilities in K.Y.E.?

For the obligation of persons with disabilities in K.Y.E., the usable public service area must be less than 100 square meters or the entire store. Specifically, I have a store with a total area of 126.60 square meters, of which 67.90 square meters is customer service space and the rest is storage, office, and preparation space.

Answer:

Paragraph 4 of Article 26 of the NOK stipulates that: “…establishments of public health interest with tables and chairs inside or outside, with a total area of less than 100 m2 may be exempted from the obligation to create accessible sanitary facilities for the public only if this causes a disproportionate burden on their owners.
Paragraph 4(d) of Circular No. 42382/16.7.13 of the Office for the Study of Persons with Disabilities of the Ministry of Environment, Energy and Climate Change states that when a building permit is issued for the use of “… health-related establishments with tables and chairs inside or outside and a total area of less than 100 square meters (not counting square meters that are not included in the floor area ratio), these spaces are required to ensure horizontal and vertical access, but are exempt from the creation of accessible sanitary facilities for the public in cases where this would cause a disproportionate burden on the owner…”.

According to the above: “… establishments of public health interest with tables and chairs inside or outside and a total area of less than 100 square meters (square meters not included in the floor area are not counted), provided that 67.90 square meters is a public service area, YOU ARE NOT REQUIRED TO BUILD A W.C. FOR PEOPLE WITH DISABILITIES.
