Clarifications from the Ministry of Environment and Energy regarding apartment division

The Directorate of Architecture, Building Regulations, and Licensing of the General Directorate of Urban Planning of the Ministry of Environment and Energy issued a document with clarifications regarding apartment division.

The document states the following:

Following the above relevant documents, we would like to inform you that, in order to divide an apartment into two, a building permit is required under paragraph 1 of Article 4 of Law 4067/12, as currently in force, given that in this case work is being carried out (addition of electrical and plumbing installations) that do not fall under paragraphs 2 and 3 of the same article, and the building plan is also amended with regard to the required parking spaces.

It should be noted that the above floor partitioning works are not included in the interior alterations referred to in paragraph 2(i) of Article 4 of Law 4067/12, for which small-scale works approval is required and which concern works on a horizontal property. Finally, it is clarified that Article 5 of Law 4067/12 “Use of buildings” refers exclusively to the requirement or non-requirement of a building permit in the event of a change in the use of a building and should not be confused with any additional construction work carried out on existing buildings.
