Notice of operation

1. Establishments of public health interest falling within the scope of this chapter shall be subject to the notification procedure laid down in Article 6, without prejudice to paragraphs 2 and 3 and Articles 29 and 30.

2. Before submitting the notification, the interested party must ensure that the store can be established at the specific location. For this purpose, a certificate is required from the Head of the competent department of the Municipality in whose district the store is to operate, stating that the specific activity can be established at the specific location.
The service responsible for issuing the certificate investigates existing land uses and other restrictions imposed by current legislation or municipal regulatory decisions, which have been issued before the date of application for the certificate, and issues the certificate within fifteen (15) days from the submission of the relevant application.

If the aforementioned deadline passes without action, the certificate is deemed to have been granted, provided that the operation of the specific activity at the specific location is not prohibited.

The certificate is valid for five (5) months from the date of issue, and within this period the interested party must submit the notification.

3. Article 285 of Law 3463/2006 (A’ 114) also applies to the notification of this article.

4. Notification shall be made exclusively through the Integrated Information System for Business Activity and Controls (OPS-ADE) referred to in Article 14.

Until the activation of the OPS-ADE for the section concerning the notification of establishments of public health interest, the notification shall be submitted either to the Municipality or to any Citizen Service Center (KEP) operating as a Single Service Center (EKE).

5. The municipality in whose jurisdiction the specific activity is to be carried out is the competent authority for monitoring and managing the notification and must notify the supervisory authorities so that they are aware of the commencement of the activity at the relevant facility.

6. The granting of the certificate referred to in paragraph 2 shall not constitute a prerequisite for the issuance of a license to commence business by the competent tax office, regardless of the legal form of the establishment.
