Land Registry: What the completion of the pre-registration in Athens shows • What mistakes did citizens find?

Interesting facts emerge from the completion of the pre-registration in Athens, with owners generally participating in the process that will secure their ownership of their property from any claims by the State.

It appears that the Municipality of Athens, which requested additional details after the deadline, received a “red card,” while the systemic banks followed suit and also failed to make a strong showing.

According to data available to economix.gr, 15,046 citizens submitted requests for corrections to their data.

The Olympic Properties in Galatsi, i.e. the Central Land Registry Office, were visited by 25,874 people between April 22 and June 24.

Of these, 8,652 received statements and 2,156 submitted supplementary applications for information.

On the other hand, 27,069 citizens chose the electronic procedure for requesting a review of their data.

Specifically, the requests for correction concern:

  • in land parcel 804,
  • beneficiary details 5,546, type of entitlement 1,914,
  • in a dispute over cadastral area/boundary dispute 140,
  • in incorrect location 44,
  • no location property 29,
  • in title/transfer/registration details 1900.

Next month, the platform being prepared by the contractor will be delivered to the Land Registry so that we can move on to the next stage, namely publication.

These days, until August 24, those who are late can informally submit any corrections, but this will complicate the process and it is not certain that they will be entered into the system.

However, posting is a second chance for inconsistent citizens, as it allows them to update the information they have provided.

This publishes the registration of declared properties and their subsequent processing by lawyers and surveyors.

In this way, everyone is given the opportunity to check, confirm, or correct any errors.

In principle, those who have submitted a declaration are eligible to participate in the posting, but beneficiaries who, for whatever reason, have not submitted a declaration by the time of posting have one more opportunity to register their entitlement and avoid unnecessary hassle in the future.

The provisional cadastral data (tables and diagrams) are posted at the cadastral offices for a period of two months.

In order to better serve beneficiaries, excerpts from the provisional cadastral tables and diagrams will be sent either to the beneficiary’s email address or by post to the contact address provided by each citizen.

Electronic posting of cadastral data: During the posting process, each beneficiary will be able to view the information concerning them electronically via the Land Registry website www.ktimatologio.gr on the e-KTIMATOLOGIO Electronic Services portal.

Each beneficiary can view the details of the listing, either by using the security codes they use in the taxisnet applications, or by creating (if they do not already have one) their personal Land Registry code and additionally entering the “three keys” found on their declaration receipt. If they use their taxisnet codes, they will see all the properties in the areas that are posted and linked to their tax identification number.

It will also be possible to submit requests for corrections to personal details electronically, using the special “Posting” application in the “Cadastral Survey” section of the electronic services. Three “keys” are required to access this service: Declaration Protocol Number, Personal Code, and Property Code, which are listed on the Declaration Submission Receipt.

Through the posting, property owners have the opportunity to check the registration of their properties and correct any errors. This process ensures that the cadastral survey will be completed correctly and that there will be no problems in the subsequent operation of the Cadastre.

Therefore, at this stage, citizen participation is essential in order to avoid unnecessary inconvenience in the future.

After the completion of the posting, which includes the submission and examination of correction requests/objections and the corresponding correction in the cadastral tables, the final cadastral data are produced, the initial entries in the Cadastre, and the Cadastral Office begins operating in place of the Land Registry.

What citizens should do

The most critical point in the posting process is the careful checking of the documents that each beneficiary will receive by post. It should be noted that each person will receive as many extracts as the number of rights they have declared.

If someone who has submitted a declaration of ownership does not receive the file sent by the Land Registry, they should contact the Land Registry Office.

Beneficiaries who, for whatever reason, have not submitted a declaration by the date of publication have one more opportunity to visit the Land Registry Office and register their rights in order to avoid unnecessary inconvenience in the future.

With the posting, everyone is informed of the recording of their rights and the geographical representation of their property, and if they agree with this information, they do not need to take any action.

Special cases

Properties that were declared but either could not be located or the information provided was deemed insufficient

Also, some beneficiaries may find rights data concerning them for which they have not submitted a declaration, but which have been derived from the processing of other data collected. For these rights, if someone continues to be a beneficiary, they must submit a declaration under Law 2308/95, paying the prescribed fixed fee (35 or 20 euros).

Deadlines for submitting requests for corrections/appeals

Beneficiaries who disagree with any of the information posted as well as anyone with a legitimate interest, may submit a request for correction of the cadastral registration or an objection within a period of 2 months for residents of Greece and within a period of 4 months for residents abroad to the Cadastral Office.

Correction requests/appeals – Forms

Correction requests and objections must be submitted in person or by proxy to the Cadastral Office. A prerequisite for their submission is that a declaration under Law 2308/1995 has been submitted and the fixed cadastral fee has been paid.
