The prohibition of drafting contracts for leasing real estate in where there are unauthorized structures or unauthorized changes use provides for the draft law “for the control and the protection of the built environment”

Until now, an engineer’s certificate was mandatory for every establishment of a real right or transfer of real estate. The engineer’s certificate for properties located outside an approved town plan is accompanied by a topographical diagram, based on the state coordinate system. Engineers’ certifications are valid for two (2) months from the date of issue.

Definitive exemption from demolition

The new draft law provides for a definitive exemption from demolition (rather than a 30-year suspension) for unauthorized constructions and uses for which the preservation process has been completed with the issuance of an Environmental Balance Contribution Title (EPI) through the Bank of Building Rights and Common Areas, only if they are located within Areas of Increased PAES Coefficient Burden. The title is granted to the main beneficiary of the property to ensure Environmental Balance and is issued by Decision of the Directorate “Control of the Built Environment and Implementation of Spatial Planning – Observatory.”

The E.P.I. Title: is nominal. For its issuance, the owner of the beneficiary property pays a fee of one hundred (100) euros, after first registering with the Bank of Greece (D.D.K.X.) by paying a registration fee of fifteen (15) euros.

PAES plans are approved by presidential decree on the recommendation of the Minister of Environment and Energy, following a proposal by the Directorate of Urban Planning (D.P.S.) and initiation of the acceleration procedure by the relevant municipality, or a group of neighboring municipalities or the region, and the opinion of the relevant municipal or regional councils and KESYPOTH.

A Strategic Environmental Impact Assessment (SEIA) is being prepared for the PAES.

In these areas, increased public spaces should be provided to ensure an improvement in the quality of life of residents. In particular, in the metropolitan areas of Athens and Thessaloniki, additional recommendations from the Urban Planning Directorate of the Ministry of Environment and Energy and the Metropolitan Planning Council are also required.

PAES outside the plan are regulated within the framework of the preparation of the TCS.
