The possibility to legalize entire arbitrary but and multitude of urban planning violations instead of just 250 euros gives to citizens the new draft law for the arbitrary construction.

This favorable provision applies to residences built before 1975 and to many minor unauthorized additions found on most houses, such as pergolas, storage rooms, chimneys, shelters, etc.

In fact, for €250, one can legalize all minor violations in their building.

With the same amount (per floor), it is possible to legalize different floor apartments and also to locate parking spaces in a different location from that specified in the building permit.

In this way, property owners will be able to settle all these outstanding issues for a very small amount and avoid the risk of being “reported” by their neighbors.

As stated in Article 96 of the draft law, which is expected to be submitted to Parliament, a total of 21 violations are subject to its provisions and are definitively exempt from demolition upon payment of a fee of €250.

The first concerns the different configuration of the apartments on a floor from that specified in the building permit. In such cases, a fee of €250 per floor is payable upon request by any interested apartment owner.

Another violation is the different location of parking spaces. Owners submit a floor plan of the existing parking spaces and the €250 is paid in a lump sum within the deadline for the first installment.

Other minor irregularities that are being rectified include the installation of structural elements (ovens, decorative faucets) in uncovered areas, reducing the mandatory planting of uncovered land by up to 20%, building pergolas, exceeding the legal chimney height by up to 1.5 meters, sewage and water tanks, exceeding the height by up to 20% in commercial, industrial and agricultural warehouses, as well as the change of location of the building with a building permit, provided that urban planning provisions are not violated, or the change of location of the building due to construction with incorrect reversal of the floor plan to a legal position. To be eligible, an application and a responsible statement by the owner, an engineer’s technical report, and photographs must be submitted.

Beyond these minor violations, a fee of €250, without the requirement to pay a single special fine, can be used to legalize arbitrary violations that have existed since 1975.

The favorable provision applies to buildings used as residences and completed before June 9, 1975.
