In the Building Coefficient, the regular semi-open spaces
The Building Coefficient should include the regularized semi-open spaces, and the owner will not have the right to further construction.
This was decided by the Plenary Session of the Council of State, which “blocks” further construction of properties with “enclosed” semi-open spaces, while paving the way for their indirect inclusion in the building coefficient. The Council of State identified constitutional problems in the provision of Law 3843/10, which allowed the owner to expand his building further, since “enclosed” semi-open spaces are not included in the building coefficient.
However, the Supreme Court accepted that this poses a risk of additional environmental impact and that further construction is not constitutionally acceptable. This means that “closed” semi-open spaces should be taken into account in relation to the remaining building coefficient by the town planning authorities, so as to avoid granting applications for further construction (on the grounds that there is a remaining coefficient), rejecting the issuance of such building permits.
