A FEW WORDS ABOUT THE NOTIFICATION OF THE OPERATION OF OBELISTS
Documents that must be kept in the store’s file (Article 4 of the Joint Ministerial Decision):
It should be noted that, according to Article 4 of the Joint Ministerial Decision, the following must be kept at the branch’s headquarters:
a) Proof of submission of the notification with a simple copy of the body of the notification attached.
b) A floor plan of the store on a scale explicitly stated on the plan, showing all areas of the store with the corresponding square footage of each area, including those provided for by specific provisions of the applicable legal framework (e.g., sanitary facilities for persons with disabilities), with an engineer’s certificate confirming that the building requirements and obligations of the applicable institutional framework for the store are met, that it meets the requirements for primary use, that the space is suitable for the specific use in accordance with the Building and Construction Regulations, the requirements of the Fire Protection Regulations, as well as the applicable urban planning provisions, and a detailed description of the store’s legal documents (e.g., building permit, any revisions thereto, declaration of unauthorized construction, exemption from demolition, building permit file update, pre-existing building from 1955, etc.). The floor plan shall be accompanied by copies of the legal documents for the space to which it refers (e.g., building permit, declaration of unauthorized construction with the relevant provisions on unauthorized construction, decision on exemption from demolition, certificate of age, etc.). .
c) Certification from the competent road authority that the traffic connection works have been completed in full and in accordance with the approved plans or entry-exit approval, depending on the category to which the facility belongs (Articles 32(1) and 39 of Royal Decree 465/1970, as applicable), if required.
d) Certificate of (active) fire protection, if required, in accordance with the provisions of Article 9 and Annex C hereof. The procedure for issuing the (active) fire protection certificate is specified in Fire Service Regulation 13/2013 (B’ 1586), as applicable at any given time. If an (active) fire protection certificate is not required, the fire protection measures and means required by the legislation in force shall be recorded in the Floor Plans as above under point b) or in a separate floor plan to be kept in the store’s file at its headquarters, which shall also contain the maintenance and proper operation logbook for active fire protection measures, as specified in Articles 4 and 9 of this document
e) A solemn declaration in accordance with the model in Annex E of the Joint Ministerial Decision by the person responsible for health and safety at the establishment, accepting their appointment (if the person making the notification is not the person responsible for the establishment).
f) The prescribed fee in accordance with the provisions of Joint Ministerial Decision No. 61167/17-12-2007 (Government Gazette 243/B/2007) or a photocopy of the proof of deposit in a bank account indicated by the electronic EKE (ERMIS-EUGO) as stated in the above notification.
g) The permit for the use of public space, if applicable.
h) The license for extended music hours, if applicable.
i) The certificate from the competent service of the Ministry of Culture and the Government Gazette declaring the monument, if required.
j) The natural gas usage permit, if applicable.
If the store is a food or beverage business within the meaning of Health Legislation, it must also comply with the terms of the relevant Health Regulation and keep the required records, which must be presented during health inspections of the business .
If the store is a store providing health-related services (e.g., hair salon, barber shop, manicure and pedicure salon, etc.), it must also comply with the terms of the relevant Health Regulation and Ordinance and keep the required records with the details of its staff, their health certificates, and certificates confirming that they meet the legal requirements to practice their profession, which must be presented during the health inspection of the business.
