License to operate a private medical practice

Steps and actions of a doctor who wishes to open a medical practice

  • Selection of area and point (space) for professional use
  • If the space is not used for professional purposes, then a change of use must be carried out by an engineer.
  • The regulations of the apartment building should allow the use of a doctor’s office or, respectively, not prohibit it.
  • Preparation and approval of a lease by the owner’s tax office
  • Starting a business at the Tax Office
  • Registration with the Medical Association
  • At the same time, the doctor must submit the following documents to the Health Department of the Prefecture in order to obtain a “License to Establish and Operate.”

Required supporting documents:

  • Application (for a joint medical clinic and dental clinic of the same specialty or co-located medical clinics and dental clinics; the application must be submitted jointly and must specify the type of clinic).
  • License to practice medicine (for companies, licenses of partners and scientific managers and other health professionals).
  • Title of medical specialty (for the company of partners and scientific directors).
  • Certificate of registration and practice of specialty with the Medical Association.
  • Affidavit (instead of criminal record) (for companies of partners or scientific supervisors).
  • Public fee in euros from the Tax Office.
  • Photocopy of police identity card or identity cards (for company of the legal representative).
  • Responsible statement by the physician:
  • for natural persons: that no other medical practice operates in another location, and that they are not a doctor in the National Health System.
  • for a medical company:
  • for sole proprietorships and limited liability companies: that they do not provide primary healthcare services in a private clinic, that they do not practice the profession individually, and that they are not doctors in the National Health System.
  • for S.A.: that he/she or his/her spouse or first-degree blood relatives are not involved in any other medical company providing primary healthcare services, that he does not practice the profession individually because he owns 51% of the share capital, or that he does not offer services to his company because he practices the profession individually (he has a private practice), and that he is not a doctor in the National Health System.
  • Lease agreement or concession agreement or contract for the purchase of the building.
  • For a medical office to be housed in an apartment building, a photocopy of the building regulations showing that the establishment of a medical office or dental office is not prohibited. In the absence of regulations, a responsible statement from the majority of the apartment building’s owners.
  • Floor plan of the medical office 1:50 in (2) two copies, with the architectural layout of the spaces and their dimensions, approved by an engineer (when there are several clinics/dental clinics, the plan shall include the details of the doctor/dentist).
  • A sworn statement by an engineer declaring that the requirements of the General Building Regulations (legality of the building, building regulations, etc.) and the technical specifications of Annexes A and B of Presidential Decree 84/2001 are met.
  • List of scientific equipment to be accompanied by:
  • copies of documents proving the acquisition or use of the equipment (purchase invoices, lease agreements, etc.)
  • CE marking certificates for equipment purchased after April 10, 2001 (for equipment purchased before that date, invoices, etc. are sufficient).
  • For shared medical practices of the same specialty or co-located practices:
  • agreement or operating charter with the terms of cooperation, certified by the Medical Association.
  • Certificate from the Medical Association confirming compliance with medical ethics as set out in the agreement or articles of association governing the operation of the medical practice.
  • For companies (sole proprietorships, limited liability companies, public limited companies)
  • the application is submitted by the legal representative
  • company articles of association that comply with the provisions of Article 11 of Presidential Decree 84/2001.
  • certification of the Medical -Dental Association, regarding the compliance with the medical ethics by the statutes of the company.
  • Certificate from the Medical-Dental Association confirming the company’s registration in the register of applicant members (doctors and dentists are prohibited from participating in two medical-dental companies).

License to operate a private clinic

  • Building permit for the building.
  • Description of the clinic’s organizational and operational data.
  • Copy of articles of association in the case of a company and title deed for land or building, lease agreement, etc.
    If the interested party does not have the above information when submitting the application for a license to establish a business, it is possible to submit it when applying for an operating license.
  • Statement regarding the estimated start date of the clinic’s activities.
  • List of the planned medical staff to be employed at the clinic, by category and specialty.
  • Description of the clinic’s capabilities for providing care and its planned equipment.
  • Summary budget for the construction of the clinic building and facilities and method of financing.
  • Public treasury collection note for each bed.
  • Table with the planned staff of other categories (nursing, administrative, auxiliary).
    For the granting of a permit to establish a Private Clinic, a self-contained and independent building is required in which the Private Clinic will operate
    and which will comply with the building and structural specifications that apply to Private Clinics at any given time,
    as well as the relevant urban planning provisions provided for the issuance of the building permit.

For the granting of the license the following studies are required:

  • Complete architectural, structural, and installation studies prepared in accordance with the specifications of the Ministry of Health for private clinics and urban planning requirements.
  • A study that will provide for the appropriate drainage and disposal system for the Clinic’s waste, which comes from patients, laboratories, kitchens, administrative and other services.
    The above studies and other technical data, prior to their submission to the competent Urban Planning Authority,
    must be approved by the Technical Services Department of the Ministry of Health in accordance with the provisions of the General Building Regulations.

    • Application which shall state the name of the clinic and copy of the criminal record for the persons who are mentioned in Articles 2 and 3 of Presidential Decree 247/21-6-1991.
    • A statement naming the Scientific Director of the clinic and the heads of the various departments, as well as copies of their criminal records.
    • List of doctors who will be employed at the clinic and certificates proving that they are registered with the Medical Association of the clinic’s region, the date of graduation, licence to practise and licence to use the title of medical specialist.
    • Internal operating regulations of the clinic
    • A list detailing the clinic’s equipment.
    • Certificate from the relevant Fire Department confirming that the required fire safety measures are in place.
    • A solemn declaration signed by the owner or legal representative of the legal entity that holds the license to establish the private clinic and by the responsible engineers, certifying that the provisions of the legislation have been complied with,
      relating to the applicable architectural, structural, and electromechanical specifications for private clinics,
      urban planning provisions, and the legal requirements for clinics.
    • Special fee per bed in favor of the Prefecture of Drama.
