• License to establish and operate a performance venue (or license to establish and operate): the enforceable administrative act certifying that a venue meets the requirements of urban planning legislation for the safe staging of performances for employees and the public, without causing disturbance to local residents, while also specifying the maximum capacity of the venue.
• Performance permit: the enforceable administrative act that specifies the maximum audience size and certifies that a performance to be given on specific dates, in a designated indoor or outdoor enclosed space, for which no installation and operation permit has been issued, can be held under conditions that ensure the safety of employees and the public and without causing disturbance to local residents.
• Maximum capacity: the maximum number of persons (employees – public) allowed in a space or performance based on the safety measures provided for in Presidential Decree 71/88.
• Performance space (or venue): the building or distinct part of a building that has functional unity and in which the audience gathers and the performance is given, or the enclosed outdoor space in which the audience gathers and the performance is given.
• Multipurpose venue: a property or complex of properties containing more than one performance space.
• Performances are permitted in theaters or venues for which an installation and operating license has been issued and within the framework specified by the relevant license. By way of exception, performances may also be held in venues for which no installation and operating license has been issued, provided that a performance license has been granted.
• In the case of a multi-purpose space, the permit is issued for each space separately.
• No installation and operation permit or performance permit is required for performances given in licensed public gathering places with a maximum capacity of less than 50 people.
• The license for the establishment and operation of a facility is issued by the relevant municipality, following the granting of preliminary approval, subject to the derogation provided for in Article 7(2) hereof, in accordance with the provisions of Joint Decision No. 21220/1-11-2011 joint decision of the Ministers of Administrative Reform and e-Governance, Interior, Environment, Energy and Climate Change, Health and Social Solidarity, Culture and Tourism (B’ 2496), upon request of the owner or the person in whose name the license is to be issued. The license has an indefinite duration.
